After over 10 years of hard-fought litigation, Pfizer and Warner-Lambert have agreed to end the consumer fraud class action lawsuit over the sale & marketing of the Neurontin (gabapentin) by paying $325 million into a Settlement Fund. People who purchased this pharmaceutical companies’ prescription drug during the proxy period of January 1, 2003 to June 30, 2004 can get cash refund from the Neurontin Third-Party Payor Class Action Settlement.
TPPs (Third-Party Payors) or plaintiffs sued defendants (Pfizer and Warner-Lambert) alleging that they violated the state antitrust laws by fraudulently marketing Neurontin. Neurontin is used to treat seizures, restless leg syndrome, and pain caused by shingles but defendants promoted the drug for a variety of uses for which it was not effective and not approved by the US Food and Drug Administration.
Plaintiffs further claimed that they paid inflated prices for the drug. Defendants did not admit these claims but agreed to settle the lawsuit to avoid expenses and the burden of litigation. You are a class member of this settlement if you are a Third-Party Payors (insurance companies, health benefit providers, and entities that provide prescription drug benefits and/or pharmacy benefits) and purchased, paid for, administered and/or reimbursed Neurontin or gabapentin sold by Greenstone LLC.
Class member are required to submit the claim form to get benefits from the Neurontin Third-Party Payor Class Action Settlement. The only way to submit the claim form is online at NeurontinSettlement.com. The last date to submit the form is October 15, 2014. Eligible class members will get benefits on the basis of how much they paid and/or reimbursed for Neurontin. The amount you will receive will be calculated by multiplying your actual amount of Neurontin purchases by 1.80.
If you are claiming for more than $300,000, then you have to provide documentation along with Claim Form. The final hearing of the case is on October 22, 2014.
