Michigan Hospital Payments Litigation Settlement for Over Price

All those who paid for medical services at a Michigan hospital between Jan 1, 2006 to June 23, 2014 are eligible to receive a monetary benefit under a class action settlement at MichiganHospitalPaymentsLitigation.com.

Insurance carrier giant Blue Cross Blue Shield of Michigan (BCBSM) has agreed to settle the class action lawsuit accusing them of violating state and federal antitrust laws. According to the lawsuit, BCBSM has used ‘most favored nation’ clauses in contracts with seventy general acute care hospitals in Michigan. And Plaintiffs allege that these clauses require several Michigan hospitals to charge inflated prices for their healthcare services. BCBSM, on the other hand, denies any wrongdoing and says that their actions have caused lower, not higher, hospital prices. Still, they’ve agreed to settle the case by paying nearly $30 million as settlement amount to avoid inconvenience and expenses associated with ongoing litigation.

The class action settlement includes all direct purchasers of medical care from a Michigan General Acute Care hospital between 1st of January 2006 and 23rd of June 2014. The class members include:
  • All individuals who paid for health care service at a Michigan General Acute Care Hospital in the form of co-pays, co-insurance or otherwise;
  • Insurers that made the payment at one of the Michigan General Acute Care Hospital for their Insureds; and
  • Self-insured units whose health plan participants had been given medical care at General Acute Care Hospitals in Michigan
Over 130 hospitals from all over Michigan are included in this case. You can check out the list of hospitals at the official website of the class action settlement.

So, if you think you’re an eligible Class Member, you will receive a part of the settlement amount which is $29,990,000. The size of the payment will be determined by various factors like which hospital in Michigan you paid, the amount paid and which insurer paid the hospital. However, the minimum payment you may receive is $40, while the maximum amount you may receive is 3.5% of the total amount you paid to get the healthcare service.

All eligible Class Members are required to file a claim form in order to receive monetary benefit from the class action settlement. You can complete the form online. You may find two different claim forms on the website. Make sure you choose the right one. One is for the consumers whereas the other is for the insurers and all those who are self-insured. Remember, the deadline to submit the claim form is 16 November, 2014.

  1. what if you don't remember how much you paid the hospital, but can prove you where hospital twice (3-4 days each time) and bcbs was you insurance carrier.

  7. I am not sure I understand your comments "just inform your query to administrative via email" Who am I asking to do a query on my expenses? I know I have paid but am unsure of how much and when. Who do I ask to help?

  8. I don't remember exact dates or how much I paid! I was sent a card saying I am eligible. I shouldn't have to come up with this info if you have it! Your claim form sucks Big Time!
