Wells Fargo Bank NA, Assurant Inc. and QBE Insurance Group have agreed to pay $32 million to resolve the ongoing class action lawsuit, alleging that homeowners were overcharged for forced-placed insurance. Class members who received a Settlement Notice Packet via mail can get cash reimbursement from the Wells Fargo Force-Placed Insurance Class Action Settlement by submitting the claim form.
Plaintiffs sued the defendants claiming that the Wells Fargo Defendants placed insurance in such a way that they received an unauthorized benefit. Plaintiffs also claimed that the Wells Fargo Defendants also got kickbacks in the form of commissions from the Assurant Defendants and QBE Defendants.
Those who were overcharged by Wells Fargo Bank for a lender-placed insurance (LPI) policy during the Class Period will receive a cash award. The Class Period is different for each state. The last date of Class Period is March 17, 2014 for all states. The beginning dates of Class period for each state is as follows:
California: October 7, 2007
Florida: September 2, 2006
Illinois: July 5, 2002
Indiana: June 15, 2002
Louisiana: February 19, 2003
New Jersey: April 2, 2007
New York: July 5, 2006
Ohio: August 8, 1998
Pennsylvania: April 7, 2005
Texas: October 7, 2007
All other states: January 1, 2008
All the eligible class members have to submit a claim form within 60 days after the Final Settlement Date, which means December 17, 2014 to get compensation from this class action settlement. The claim form can be submitted via two ways online at FladellSettlementInfo.com or mail.
Once the Court approves the Settlement on the Fairness Hearing, class members will get 11% of the Net Premium charged for the LPI Policy before March 24, 2012 and 7% of the Net premium charged for the LPI Policy after March 24, 2012.
