According to the settlement, entitled people may seek refund of up to $5 per box, and with a maximum of $15 for each customer. Also, note that if the total of valid claims is a smaller amount than the amount of money offered to pay them, then valid claims will be 3 times more of the original value of the claim, for a total prospective recovery of up to $45 per Class Member. If the total of valid claims goes beyond the amount of money available to pay them, then each grant will be decreased on a pro-rata basis.

Under the settlement, Kellogg also approved to make some changes to the marketing and labeling of Frosted Mini-Wheats.

When & how to claim?

Now for receiving payment of settlement, claim forms must be fulfilled and submitted either online or postmarked. This should be done by no later than 80 days, once the Court enters the Judgment. Most probably, the deadline date will not be prior than November 28, 2013; however the exact date will be available as soon as the Court enters the Judgment.

There is no need of any purchase proof. One thing for sure is that if you have submitted a Claim Form in the past settlement of this case, then it is okay! Claims must be postmarked by: 80 days after the Judgment. The Claim Form deadline will not be earlier than November 28, 2013, but may be later. The exact date will be available, once the Court enters the Judgment.

  1. I filed a claim for this, and have a claim number, but have never received any kind of payment as a result. Has anyone out there seen a check from this?

  2. I called about this and actually got a call back. I guess the settlement that was made got rejected for some reason, and it went back to the court. The lawyers haven't bled enough of the money out of it yet probably. From what I understand, they initially said up to $15 but it is going to be way, way less than that.
