Papa John’s Text Message Class Action settlement has arrived with all important details. Papa John’s company has agreed to give refund of $50 to all the eligible class members. If you have received at least one unsolicited text message from the Papa John's pizza chain, then you are eligible to claim for your $50 refund.
Papa John's has agreed to do settlement in the Papa John’s Text Message Class Action by providing $16.5 million to settlement authority. Class members have claimed that Papa John’s pizza chain has sent more than 500,000 illegal text messages to their customers for the advertisement of pizza chain. Company has sent all those illegal text messages without the permission of customers. Due to this unwanted text messages; company has violated the Telephone Consumer Protection Act (TCPA).
Papa John's pizza chain has denied telling that this is not their fault as customers only have provided their number to the company and as franchisee, customer cannot file a class action against company because text messages are circulated by their hired marketing company OnTime4U. So, now with Papa John's, OnTime4U is also listed as a defendant.
All these defendant’s arguments have been rejected by federal judge; both defendants and class members have agreed that if any customer received even one unsolicited message, which do marketing of Papa John’s product serviced by OnTime4U, then those customers are eligible to claim their refund of $50.
Every potential customer who has submitted the claim form; will receive $50 from the class action settlement and free Papa John’s pizza voucher code to do online purchase from Papa John’s. Last date to submit a claim form is September 10, 2013.
