LA Fitness has agreed to do settlement to clear their class action filed by consumers, who have claimed that LA Fitness International has continued to charge them even after they have cancelled their LA fitness membership. If you have agreed to LA Fitness International’s Fitness Service Agreement during the time period of February 28, 2006 to March 31, 2012, then you can claim for the settlement to get your refund.
As per the LA Fitness Class Action Settlement, consumers have claimed that fitness club chain has violated the New Jersey Consumer Fraud Act (CFA) by charging some consumers after they have cancelled their membership. Plaintiff has also claimed that LA fitness has violated the state’s Truth-in-Consumer Contract, Notice, and Warranty Act (TCCWNA).
LA fitness has denied about any wrong going but has agreed to do settlement. Class Members of the LA Fitness settlement are broken down into two groups:
Fitness Service Agreement Class:
In this group, all consumers are included who have entered into a Fitness Service Agreement with L.A. Fitness in the State of New Jersey during the time period of February 28, 2006 to March 31, 2012.
In the LA Fitness Class Action Settlement, they will get two options to choose what kind benefit they want. They can receive either two free individual personal training sessions of 25 minutes each with a certified personal trainer or credit of $100 to be applied toward the purchase of a new Monthly Dues Membership at any L.A. Fitness.
Membership Agreement Class:
All consumers who have entered into Monthly Dues Membership Agreements with L.A. Fitness in the State of New Jersey or who paid for dues of an additional month after L.A. Fitness received and processed a Notice of Cancellation during the time period of February 28, 2006 to March 31, 2012 or consumers, to whom payment of the additional month of dues was not subsequently refunded, will get refund as the 45 Day Access Pass to any L.A. Fitness facility in New Jersey, except Signature Club locations under the LA Fitness Class Action Settlement.
