Verizon has agreed to settle a long-running class action lawsuit over Family Plan over-billing by paying $64.2 million. Verizon Wireless Store
Plaintiffs named Ralph Demmick and Donald Barth filed a class action lawsuit in 2006 against Verizon Wireless on behalf of other people with similar claims. They allege that the Verizon billed Family Share Plan customers for “In-Network” or “In-Family” calls that were supposed to be free under the plan. They further claim that company over-charged them for “after-allowance” minutes they used over their monthly allowance. Thus, Verizon violated its customer contracts as well as state and federal law.

Verizon refused these claims but decided to end the lawsuit for avoiding further expenses of ongoing lawsuit. $36.7 million settlement fund will be paid to class members in cash and $27.5 million fund in phone credits. The remaining $19.26 million will be used to pay legal fees of the lawyers.

There are two groups of the Class Members: the FSP Settlement Class and the In-Network Settlement Class.

FSP Settlement Class: The class includes U.S. residents who were subscribed to a Verizon Family SharePlan covering two or more persons with different per minute rates for minutes used after the shared plan allowance was exhausted and who were billed under I2K billing system & over-charged for “after-allowance” minutes.
The In-Network Settlement Class: It includes U.S. residents who were subscribed to a Family SharePlan that offered free "In-Network" and/or "In-Family" calls and were charged for "In-Network" and/or "In-Family" calls.

Class members who received a notice regarding the settlement will automatically get benefits from the settlement. But, the class members who don’t receive a notice have to submit a Claim Form before April 29, 2015. The Claim Form can be submitted via two ways: online at www.verizonFSPclassaction.com and via mail to Kurtzman Carson Consultants LLC, Settlement Administrator, P.O. Box 43329, Providence, RI 02940-3329.
