A federal judge has granted preliminary approval to two class action settlements with GAF Materials Corp. involving Timberline Roofing Shingles. A lawsuit filed against GAF alleges that its shingles are defective and they’re prone to premature failure by cracking, splitting or tearing. The manufacturer has denied the allegation of its shingles being defective and also maintains that its warranty covers the cost of any kind of damage. Still, they’ve agreed to settle the ongoing legal case simply to avoid the expense and uncertainty associated with it. So, if granted final approval, all the property owners with damaged GAF Timberline roofing shingles manufactured between 1998 and 2009 will receive free replacement of shingles or a cash payment under the proposed class action settlements.
The GAF Timberline shingles settlements will cover claims for (a) cracked shingles (b) damage to the roof system (including underlayment, leak barriers, ridge cap shingles, attic ventilation, etc.), and (c) damage to other building materials (i.e. anything directly connected to the roof system including siding, gutters, plumbing vents, etc.).
Who all are eligible for Settlement Benefits?
There are two GAF shingle settlements, covering two different types of Class Members
Mobile Settlement Class: Includes any eligible person or business who owns property in the U.S. with Timberline Shingles manufactured from January 1, 1999 through December 31, 2007 at GAF’s plant in Mobile, Alabama. There’s also a subclass of those who own property in South Carolina.
Non-Mobile Settlement Class: Includes any eligible person or business who owns property in the U.S. with Timberline Shingles manufactured from January 1, 1998 through December 31, 2009 at other GAF plants in the United States.
Note: Builders, contractors, developers, and others who meet certain criteria are not included in the settlement. Details regarding who’s included and who’s not can be found in the long form notice.
Potential Award
All eligible Class Members who claim for the Settlement benefits will receive replacement shingles or a cash payment.
How much you get and what you get will depend on factors like where your property is located, the size of the roof, the place where the shingles were made, the installation date of shingles, and the extent of damage occurred to the shingles. You may also get cash payment for other associated damages, such as labor cost or damage to other building materials.
How to file a claim?
In order to make a claim for the Settlement benefits, you must submit a Claim Kit before the deadline. The claim kit includes a Claim Form, one full size & intact cracked Timberline shingle, and supporting photographs & documents.

I had many cracked shingles.
ReplyDeleteI bought 30 year timberline shingles 13 years ago.
I was wondering if they would just offer the usual pro-rated deal for the price of the shingles only (like when no law suit) or actually offer some labor.
I went through the entire process, lots of photos, removed one shingle and sent it in, blah, blah, blah.
Wow I got my settlement letter today.
Adding the "cash settlement" and the "other damages" topgether it came to a whopping $50.40.
That was not a typo….. FIFTY BUCKS.
Not sure exactly what the deal is but either they can’t add or this is one of those "class actions" where the lawyers get all the money ?
Either way I won’t be accepting that offer. This is BS !
