SiriusXM Multistate Settlement Program for misleading advertising & billing

Some Sirius XM customers sued Sirius XM for getting refund of the charges paid for satellite radio service they didn't want. Here customers complained that it was difficult to cancel their Sirius XM contracts, also some said that Sirius XM automatically renewed contracts without permission. In regarding, Sirius XM has agreed to make some changes to its business, like improving its cancellation process and sending notices before automatic renewals. And most importantly, Sirius XM agreed to pay $3.8 million to settle complaints that it deceived customers with its advertising and billing practices.

It is alleged that Sirius engaged in misleading, unfair, and deceptive acts or practices, violating the state consumer protection laws. As per the consumers complaints, cancellation requests were not honored; contracts were automatically renewed without consumers’ notice or consent; also there was difficulty in canceling contracts; misrepresentations that the consumer’s Sirius service would be canceled and not renewed; unauthorized fees; higher and unanticipated rates after a low introductory rate; as well as, Sirius failing to give timely refunds.


Even it is mentioned in the complaint that Sirius gave extra incentives to its customer service staff based on how many customers they retained when they go for cancellation.

SiriusXM has entered into agreements with 46 States and the District of Columbia, so called multiple settlements. As this is a multi-state settlement, so the money will be split among 46 states and the District of Columbia, excluding four states, California, Hawaii, Wyoming and New York. Even, residents of these four states can’t apply for a refund.

Eligible consumers under this settlement must file a complaint involving an identifiable loss that was not previously resolved. Here identifiable loss might be a loss of money from instances where the consumer disastrously tried to cancel or did not want to renew, but found themselves stuck paying for one more term. Identifiable loss may also include a loss of time, like when the conversation took much longer than practically expected due to problems with customer service.

It is expected that a portion of the roughly 400,000 Hoosiers who may have subscribed to Sirius XM could be eligible for refunds. Sirius XM Radio Inc. of New York has agreed to pay a total of $3.8 million and provide restitution to eligible consumers who have complaints about the problems addressed by the settlement. The refund amounts will be different on a case-by-case basis. Besides its $3.8 million settlement fund, Sirius XM will make significant changes to its business practices under the terms of the settlement.

Consumers who negatively impacted by Sirius XM’s tactics should file a complaint before May 3, 2015, visiting at the respective Attorney General’s Office or by calling at 800-382-5516. At the claiming, make sure that you have not previously filed a complaint with their attorney general for the practices covered by this settlement. Also, consumers can file a complaint directly with Sirius XM.

Who’s eligible?
  • Customers who may have been illegally charged from 28th July, 2008 to 4th December, 2014, can apply for a refund from their state's attorney general office or from Sirius XM.
  • Customers who have not previously submitted a complaint, but whose problems with Sirius are unresolved. (Customers, whose complaints were unresolved, need to resubmit your complaint)
  • Residents of any state are eligible, except for residents in California, Hawaii, Wyoming and New York.

What's in the SiriusXM Multistate Settlement?

Consumers will get restitution as part of the settlement. Also for part of the settlement, which officials refer to as an "assurance of voluntary compliance," Sirius has agreed for
  • Clearly disclose all terms and conditions at the point of sale, such as billing frequency, term length, automatic renewal date, and cancellation policy.
  • Make no misrepresentations about the available plans in advertisements.
  • Provide advance notice of upcoming automatic renewals for plans longer than six months
  • Improve cancellation procedures
  • Prohibit incentives for customer service representatives based solely on retaining customers who attempt to cancel.
