On January 21, 2009, Mike Hernandez filed his complaint against Old Navy as a supposed statewide class action with Case No. CGC-09-484299 (“Hernandez”). He alleged that Old Navy requested and recorded certain personal identification information, including but not limited to ZIP codes, when he made payment for purchased merchandises with a credit card at a California Old Navy brand store. Also, he alleged that Old Navy consequently used his name and ZIP code to obtain his address. Considering this alleged conduct, he asserted two claims: (1) violations of California Civil Code section 1747.08 (“Section 1747.08”); and (2) invasion of privacy. On April 14, 2009, the case was deemed complex, and allotted for all purposes to the Honorable Richard A. Kramer.
