Those who bought a “new” BMW vehicle within the time period of September 28, 2006 to before October 6, 2014, then it can be a demonstration car. BMW of North America has agreed to settle a class action lawsuit over Demo cars. The company will provide warranty extension and reimbursement for past expenses to all the class members of the BMW Demo Vehicle Class Action Settlement, who submit a valid claim form at SainivBMWSettlement.com.
Plaintiff named Sanjay Saini filed a class action lawsuit against BMW claiming that the company dealers sold sales demonstration ("sales demo") and Aftersales Mobility Program ("service demo") vehicles as New with an "ultimate warranty" without informing them the cars were demo cars. The dealers also informed to customer that the limited warranty for the vehicle had started before they purchased the vehicle. BMW denies these claims but agreed to end the lawsuit.
Class members include the initial purchasers of a BMW sales & service demo vehicle that was identified in the sale contract as “New” and whose warranty had begun prior to customer purchase. Class members have to submit a claim form along with needed documents before February 3, 2015 to get benefits from the BMW Demo Vehicle Class Action Settlement.
Two different types of claim forms: Sales Demo Vehicles and Service Demo Vehicles available at SainivBMWSettlement.com. You can file submit the Claim Form online the official website of settlement or via mail. If you want to submit the form via mail, then just download the copy of form and mail it to the address provided on the Claim Form.
A 3-month extension on vehicle warranty's time period from 48 months to 51 months from the vehicle's In-Service Date. The 3-month extension benefits will be subject to a 55,000 mile limitation.
Class Members have to provide appropriate proof to get 3-month extension, such as a copy of the dated vehicle sales agreement identifying the vehicle as "new" containing the VIN and a confirmation by Class Member that he/she was not informed that the vehicle was a service demo whose warranty had started running.
Reimbursement for Past Expenses:
A 100% repayment of the amount you spend for repair of the vehicle.
Class Members also have to provide appropriate proof to get reimbursement, such as a copy of the dated vehicle sales agreement identifying the vehicle as "new" containing the VIN, a confirmation by Class Member that he/she was not informed that the vehicle was a service demo whose warranty had started running and documentation demonstrating the nature of the repair, the cost of the repair, the date of the repair, the VIN, and the vehicle's mileage at the time of the repair.
