Ghirardelli Chocolate Co. has decided to end a class action lawsuit over false advertising by paying $5.25 million as compensation to class members. People who purchased certain Ghirardelli Products in U.S. during the time period of August 17, 2008 to October 2, 2014 are eligible to get benefits from the Ghirardelli White Chips Settlement. The company denies any wrongdoing but agreed to settle the lawsuit to avoid risk and expenses.
Plaintiffs filed a lawsuit against Defendant, claiming the company violated consumer protection laws as it falsely advertised that some of its baking chips contained white chocolate. Plaintiffs also claimed that Ghirardelli misled the consumers by labeling and marketing its certain products as “all natural”. According to plaintiffs, certain Ghirardelli products are not all natural and did not include any white chocolate.
To get benefits from the settlement, you must submit a claim form. Claim form is available online at WhiteChipsSettlement.com. You can submit it along with or without proof via two ways: online or via mail to the Claim Administrator at: Miller et al. v. Ghirardelli, c/o GCG, PO Box 10114, Dublin, OH 43017-3114. The last date to submit the form is March 19, 2015.
Class members who submit the claim form without proof will get $1.50 for every bag of White Chips and $0.75 for other Products. Those who submitted the form along with Proof of Purchase can get up to $24. As a part of settlement, Ghirardelli will also make certain changes to the labeling of the Products.
Ghirardelli will use the phrase “Classic White Chips” in place of “Classic White” on its White Chips packaging. It will also not include the phrases such as “baking chocolate” or “chocolate indulgence” on its White Chips packaging and “all natural” on any Product.
