Plaintiffs filed class action lawsuit against Defendants claiming that they labeled and marketed their vitaminwater brand beverages as a healthy drink containing nutrients and did not inform customers the amount of sugar in Vitaminwater. If you are a legal resident of Florida, Ohio, Illinois, Missouri or the U.S. Virgin Islands and purchased vitaminwater brand beverages (excluding vitaminwater 10 and vitaminwater zero) between January 1, 2003 and September 25, 2014, then you are a part of the Vitaminwater Deceptive Marketing Class Action Settlement.
Defendants are not providing any monetary benefits to the class members. However, they are providing injunctive relief which means the Defendants will make certain changes to the labeling and marketing of vitaminwater beverages. As a part of settlement, Defendants will state the amount of calories per bottle on the front of pack as well as write in bold type, "See nutrition facts for more detail," on the front label.
Also, they will not make certain statements regarding the drinks and their effects on the body on the Product’s labeling and marketing. The final hearing for settlement is going to take place on December 2, 2014.
