Flax USA is the newest target in the wave of false and misleading advertising class-action lawsuits over “all-natural” claims. The company has agreed to settle a class action lawsuit by providing monetary benefits to class members. People who bought flax milk sold in 32-oz size cartons (unsweetened, vanilla and original flavors) in the United States between November 5, 2009 and September 22, 2014 are eligible class members of the Flax USA Flax Milk Class Action Lawsuit Settlement.
Plaintiffs filed a lawsuit against Flax USA alleging it mislead consumers by describing flax milk products as ‘all-natural’. Flax USA’s flax milk products are not all-natural as they contain artificial or synthetic ingredients such as Tricalcium Phosphate, Xanthan Gum, Vitamin A Palmitate, Vitamin D2, and Vitamin B12. Flax USA denies these allegations but agreed to settle the lawsuit for avoiding risk and expense.
Class members have to submit a claim form in order to get the compensation. Claim form can be submitted via one of the three ways: online, mail and fax before April 28, 2015. As a part of settlement, Flax USA will not use the phrase “all natural” on any flax milk label. Class Members who provide details of their retailer or the retailer’s location where they purchased flax milk can get up to $3.25 per carton while class members who don’t identify the retailer can receive up to $2.50 per carton. Each class member can claim for up to a maximum of 10 cartons.
