A settlement has been reached in a massive class action lawsuit against National Football League (NFL) alleging the league hid the dangers of head trauma. Retired NFL players filed a class action lawsuit against National Football League and NFL Properties (NFL Defendants) claiming that they concealed the risks of repetitive traumatic brain injuries from players during their NFL football playing careers and even don’t warned them regarding the long-term risks of these injuries. NFL Defendants refuses these claims but agreed to settle the concussion lawsuit to avoid the risk and expenses of continued litigation.
There are three categories of claimants:
Retired NFL Football Players: All NFL players who have retired (formally or informally) from playing football with the NFL or any Member Club before July 7, 2014 as well as players who were previously on any roster of any Member Club or league and are no longer under contract or seeking active employment as a player with any Member Club.
Representative Claimants: Authorized representatives of deceased, legally injured or incompetent retired NFL players.
Family Members: Spouses, parents, dependent children or other persons who properly under applicable state law assert the right to sue independently or derivatively by reason of their relationship with a living or dead retired NFL football player.
Two Subclasses based on the Retired NFL Football Player’s injury status before July 7, 2014:
Subclass 1: All the Retired NFL Football Players who were not diagnosed with ALS, Parkinson’s Disease, Alzheimer’s Disease, early or moderate Dementia or death with CTE before July 7, 2014 and their Representative Claimants and Derivative Claimants.
Subclass 2: All the Retired NFL Football Players who were diagnosed with ALS, Parkinson’s Disease, Alzheimer’s Disease, early or moderate Dementia or death with CTE before July 7, 2014 and their Representative Claimants and Derivative Claimants.
