U.S. Magistrate Judge Madeline Cox Arleo preliminary approved Osram Sylvania Company to pay $30 million for settling a class action lawsuit because the company falsely boasted about the advantage of its headlights to entice consumers into overpaying. According to court documents, Sylvania sold as many as 60 million replacement headlights during the class period. Sylvania denied any wrongdoing, however agreed to settle the false advertising class action lawsuit to avoid the risk and uncertainty of trail. Under the terms of the class action settlement, the company has agreed to give partial refunds to class members and change the packaging on the listed products.
One of the consumers Imran Chaudhri had filed the lawsuit in September 2011, claiming that the company represented that the headlights are brighter, give a wider beam and permit drivers to see farther down the road compared to standard halogen headlights, but in reality, the company had "rigged the process" and committed consumer fraud. Sylvania failed to disclose to consumers that those comparisons aren't based on the same testing environments, Chaudhri told, adding that SilverStar headlights usually sell for almost double that of Halogen headlights. According to the settlement terms, class members are eligible to receive at least $10; however the actual amount of the payment will be based on the number of eligible claims submitted.
Class Members of the Sylvania headlight class action settlement consist of all individuals and entities in the United States who bought one or more of the following products from September 22, 2005 - July 11, 2014: SilverStar ULTRA, SilverStar, XtraVision or Cool Blue replacement headlight capsules; SilverStar, XtraVision or Cool Blue sealed beam headlights; and SilverStar fog or auxiliary lights. Class Members have to either give proof of purchase like a receipt, credit card record, document or product packaging; or swear under assurance that they bought one of the covered products. In case, you received a postcard notice in the mail, then you don’t have to submit a claim form. Once the Sylvania headlight settlement receives final approval, you will automatically get a payment.

I replaced my headlights with a pair of Sylvania halogen headlights in my 2000 Jeep Sport in 9/19/2008 I'm not sure if I can find my recite but they are still on my Jeep.
ReplyDeleteDOES THE CLAIM OF FRAUD INCLUDE SEALED BEAM REPLACMENT HEADLIGHTS. BECAUSE I PURCHASED A PAIR OF NEW HEAD LIGHTS ON THE BASIS THAT THEY WOULD GREATLY INPROVE MY NIGHT TIME VISION GREATLY AND THEY DID NOT AND I WAS FORCED TO CHANGE BACK . NOW I WENT OUT AND SPENT OVER 200 DOLLARS TO CONVERT TO H. I. D.
