A one-year old dispute comes to an end, as WMG (Warner Music Group) has decided to pay $11.5 million to settle a class action lawsuit over royalties for ringtones and digital downloads. The company has agreed to make cash payments to all its recording artists and music producers, who signed a contract before January 1, 2002 and paid on a Royalty Rate Basis/ a Penny Rate Basis. Class members can get cash payments of the past royalties from WMG Download Royalties Class Action Lawsuit by submitting a claim form.
Plaintiffs (Kathy Sledge Lightfoot, Gary Wright and Ronee Blakely) filed the class action lawsuit claiming that the music giant's miscalculated royalties for digital downloads like MP3 files and ringtones. They also claimed that the company paid royalties to them on licensing basis rather than royalty basis. So, the amount of royalties received by artists decreased.
As part of the deal, all class members will get payments for earlier miscalculated royalties as well as a 5% increase in their future royalty rates. WMG is still refusing these claims as it believes there was no evidence or proof of wrongdoing. However, WMG has agreed to settle the lawsuit for avoiding expenses.
In order to get benefits from the Settlement, you are required to submit a claim form before May 31, 2014. The claim form is available at the official website of the settlement. Just download the claim form and mail the completed form to WMG Download Class Settlement, PO Box 8094, Faribault, MN 55021-9494. The Fairness Hearing will take place on October 2, 2014.
