BMW of North America LLC (BMW NA) have agreed to settle down the class action for some of the MINI Cooper vehicle’s transmission defects. If you also have owned or leased 2002-2006 MINI Hardtop or 2005-2008 MINI Convertible, then you are entitled for compensation in the lawsuit settlement.

Class members have claimed that BMW NA become unfair and mislead about making their customers aware of certain MINI vehicles equipped with CVTs are defective and may sustain premature CVT failure. It leads to violation of various acts such as violations of California Consumer Legal Remedies Act, violations of Unfair Business Practices Act, Breach of Implied Warranty pursuant to Song-Beverly Consumer Warranty Act, etc. BMW NA has denied of any wrong going still agreed negotiating for the class action.
All the current and former owners and lessees who are residential of United States and have following vehicle equipped with a CVT are eligible to file a claim into the Mini Cooper Settlement:

• 2002 through 2006 model year MINI Cooper (R50), produced during June 11, 2001 to November 28, 2006
• 2005 through 2008 model year MINI Convertible (R52), produced during the time period of March 6, 2004 to July 31, 2008

Any eligible person who had the CVT repaired or replaced at a MINI or BMW dealership will get a 3 year/500,000 mile parts warranty. People who have sold their vehicle for $4,000 or less without doing any repairing will get refund of $1,000 and $2,000.
