How to Claim for Flushmate Class Action Settlement?

Flushmate Flushing Systems are installed in toilet tanks of over 2.3 million toilets in the U.S. and Canada. Flushmate, the maker of a high-pressure flushing system has faced many lawsuits for selling defective Flushmate III Pressure-Assist Flushing Systems (Series 503) that shatter the toilet tank or causes toilets to explode. If own or owned a toilet that has a Series 503 Flushmate III Pressure-Assist Flushing System, then you may claim and get cash reimbursement from the Flushmate Class Action Settlement.

Flushmate has agreed to pay $18 million as compensation in the Class Action Settlement to resolve multiple class action lawsuits. The Series 503 Flushmate III Pressure Assist Flushing Systems manufactured between October 14, 1997 and June 30, 2009 are involved in the Flushmate Class Action Settlement. The Consumer Product Safety Commission (CPSC) has already issued two recalls (in June 2012 and January 2014) of Flushmate III Pressure-Assist Flushing Systems in the U.S and Canada.


Five class action lawsuits were filed against the company after multiple consumers complained that they suffered from personal injury and/or property damage due to the explosion of the defective Flushmate III Pressure-Assist Flushing Systems. Affected consumers were forced to pay for out-of-pocket costs for repairing and replacing the units.

Toilet manufacturers who used defective Flushmate Systems are American Standard, Crane, Ecotech, Eljer, Gerber, Kohler, Mancesa, Mansfield, Orion, St. Thomas, Universal Rundle, Vitra, Vitromex and Western Pottery. Toilets equipped with Flushmate Systems were not only sold via distributors and plumbing contractors but also at Home depot and Lowe’s stores.

All Flushmate III Systems are not part of the Settlement. Flushmate Systems manufactured between October 14, 1997 and June 30, 2009 are included in the Settlement. To know whether your Flushmate System is a part of Settlement or not, lift the toilet fixture’s porcelain tank lid to see the serial number located on the label on the top of the System. The manufacturing date code range for the Settlement is from 101497 to 063009.
Class members are required to submit a claim form along with a proof (copies of invoices or receipts) for getting compensation from the company. If you don’t have invoices or receipts, don’t worry you can list the serial number or provide other proof of ownership of the Flushmate System.

Class members will get compensation for out-of-pocket expenses (made for installing a Flushmate repair kit, a replacement Flushmate pressure vessel and/or a replacement toilet) and direct property damage caused by a Flushmate System that leaked or burst. It is expected that Class members will receive at least $50 for the first Flushmate Toilet and additional $25 for each Flushmate Toilet located at the same Property address.

How to File a Claim for Flushmate Class Action Settlement?

You can file a claim in various methods: online, mail, email and facsimile. There are two different claim forms: Non-Property Damage Claim Form and Property Damage Claim Form for direct property damage. Those who made only out-of-pocket expenses should submit Non-Property Damage Claim Form. The last date to submit a claim form is September 24, 2016.

To file claim online: Logon to www.FlushmateClaims.com and hit the “claim forms” tab. Press the “Submit online” button given under your appropriate Claim Form. Then, complete and submit the form by entering the required details.

To file claim by other methods, you need to take print out of the appropriate Claim Form from the official website. You can also get Claim forms by calling 1-877-412-5277.
