Discover Financial Services has agreed upon the class action settlement on TCPA violation. The issue was about the usage of an automated telephone dialing system and/or an artificial/ pre-recorded voice to be placed on non-emergency telephone calls on the cellular telephone. This call was made between November 30, 2007 and September 10, 2013 without consent of the Plaintiffs and the putative class members. The Discover Financial Services has violated the Telephone Consumer Protection Act, 47 U.S.C. Initially, Discover refuses the allegations and any claim also. And the court has not decided who is right. But, Discover has agreed on class action settlement and the settlement fund is $8.7million. The settlement payments will be between $20 and $40, as per the estimation of Class Counsel. But it can be vary on the basis of various factors such as number of submitted claims.
If you are eligible to claim, you must file up your claim before February 25, 2014. You can file claim in two ways: by online or by downloading the claim form. If you file a claim offline, you must submit the claim form via mail before the above stated last date of claim. You can opt out from the settlement by sending a request for exclusion before January 13, 2014. If you opt out from the settlement, you will not get any money or other benefits of the settlement.
