During the past few years, false advertising related class action lawsuits are rising at an alarming pace. False advertising class action lawsuits have filed against many companies and brands. Recently, USPlabs and GNC have come across the class action due to false advertising their dietary supplement products named OxyElite Pro, Jack3d and VERSA-1. USPlabs and GNC (Defendants) have agreed to pay $2 million for putting an end to a class-action lawsuit.
In November 13, 2013, Plaintiffs filed a class action lawsuit against defendants claiming that they made misleading statements regarding the lawfulness, safety, and effectiveness of the USPlabs Products which contained DMAA and aegeline. Thus, violated state consumer protections laws and the Magnusson Moss Warranty Act. Defendants refuse these claims but agreed to settlement the lawsuit.
People who bought USPlabs Products from August 17, 2012 until the date of Settlement for personal use are eligible class members of the OxyElite Pro, Jack3d, VERSA-1 Class Action Settlement. They have to submit a claim form along with/without proof before February 5, 2015 in order to get monetary benefits from the settlement.
The claim form is available at the official website of settlement. The claim form can be submitted via two ways: online at USPlabsClassAction.com and via mail to: USPlabs Settlement Administrator, PO Box 43319, Providence, RI 02940-3319.
Class members will get $35 for per bottle/container of OxyElite PRO, $20 for Jack3d and $20 for VERSA-1. Class members who submit the claim form without proof of purchase can get a maximum compensation of $150 whereas there is no limit of payment for class members who submit proof of purchase. The payments will be made through checks after the final approval of the Settlement.
