Non-customers, who have received a Text Message from Wells Fargo related to “send/receive money product” program prior to June 20, 2013, are entitled to file a claim on WellsFargoTextSettlement.com and get cash payment.
A class action lawsuit has been filed against Wells Fargo alleging that the bank has violated a provision of the Telephone Consumer Protection Act (TCPA) by sending text messages to non-customers on their cell phone numbers without that person’s prior consent. Defendant denies violating the TCPA act, but they’ve agreed to pay $950,000 to settle the lawsuit. So, if you’ve received a text message from Wells Fargo in connection with its “send/receive money product” program between December 18, 2008 and June 20, 2013, and you were not a customer of Wells Fargo at that time, then you’re eligible to get a share of this settlement fund.
All eligible class members are required to file a claim in order to get the payment. There are three ways to make a claim: (1) call 1-855-309-1484 (2) Go to settlement website www.wellsfargotextsettlement.com or (3) Mail a claim form that can be downloaded from the site. The deadline for submission of claim form is August 7, 2014. To make a claim, you must provide your Claim ID from your postcard Notice (if you’ve received such notice), and your cell phone number, on which you may have received the text message from Wells Fargo. Now if you don’t have a Claim ID, still you can file the claim by selecting the “I don’t have a Claim ID” option.
Proof of Purchase: If your cell phone number matches a number listed in Well’s Fargo’s records, you’re eligible to submit a claim for the settlement.
Potential Award: The settlement fund will be distributed among qualified claimants on a pro-rata basis, meaning the amount that will actually be paid to each class member will depend upon the total number of claims filed and approved.
